29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.     The employer is failing to protect employees from potential fall hazards associated with accessing elevated working surfaces without adequate fall protection.  This was most recently evident during the inspection of the facility located at 1928 S. Lincoln Ave, York, NE 68467, where the employer has employees using an unprotected work platform to reach high enough to repair the electric motor on the front of a 1974 CGI model 5400 mobile crane.  Instance includes but are not limited to:    i.  Employee using a Bobcat model 5300 skid steer with a forklift attachment to lift a pallet without any railings high enough for the employee to work on the crane listed above without any type of fall protection.
