29 CFR 1926.1101(k)(2)(ii)(C): Building and/or facility owners shall notify all employers of employees who will be performing work within or adjacent to areas containing ACM or PACM of the presence, location and quantity of ACM or PACM, at the work sites in their buildings and facilities. Notification either shall be in writing, or shall consist of a personal communication between the owner and the person to whom notification must be given or their authorized representatives: a) WillMax Capital Management @ 3190 W 14th Ave, Denver CO: On and before February 12, 2014 the property management company did not ensure contractors hired to make modifications to the concrete flooring were notified of the presence, location, and quantity of ACM in the floor tile mastic. Employees of the concrete subcontractor removed floor tile mastic in the common areas and hallways of at least 10 floors in total between Towers 3 and 8. The floor tile mastic was an asbestos containing material. The floor tile mastic was tested and determined to contain 3-5% chrysotile asbestos. The employees of the concrete subcontractor performed Class II asbestos work. Floor tile mastic was removed by mechanical means using abrasive grinding equipment. Flooring modifications activities in Towers 3 and 8 took place from November of 2013 to February of 2014. At no time during the discussion of the scope of work or during the active renovations was the concrete subcontractor informed of the presence, location, and quantity of ACM in the floor tile mastic. This condition exposed subcontractor employees to an asbestos hazard.
