OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards.   a) Plant production area  On or about and at time prior to March 4, 2014, the employer did not ensure employees were trained on the safe operation and use of below the hook lifting devices such as, but not limited to Industrial Strength Magnetic Lifts (Earth Magnets). The lifting magnets load rating, testing data and manufacturers safe and proper use was not known, exposing employees to crushing and struck-by hazards.      ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a)  Forklifts used throughout facility - On or about and at times prior to March 4, 2014,  forklifts were purchased with pre-existing holes cut near the fork tips,  and the employer used a trailer ball hitch attached to the forks to push and pull trailers used to transport storm shelter shelters.  The employer used the modified application without pre-approval from the forklift manufacturers, exposing employees to tipping, ejection, and struck-by hazards.     ABATEMENT CERTIFICATION IS REQUIRED
