29 CFR 1926.201(a):  The use of flaggers, signaling by flaggers or the warning garments worn by flaggers did not conform to Part IV of the manual on Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA, which are incorporated by reference:     a)  The violation was most recently observed on or about March 10, 2014, on W. Webster Ave., at or about N. Hudson Ave., where the employees were exposed to the hazard of being struck by moving vehicles while performing flagging tasks within an active roadway without sign paddles or flags to safely transfer vehicular traffic, as required by the Part VI of the MUTCD 1988 Edition, Section 6E-4.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1):  Each employee in an excavation is not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):      The employer does not protect each employee in its excavations by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.        a)  This most recently occurred on March 10, 2014, at 437 W. Webster Ave., Chicago, Illinois.  Employees are exposed to cave-in hazards while installing a water service in a trench without cave-in protection that is approximately 6 feet in depth.        To abate this hazard in the future, the employer must ensure that it's excavations are properly sloped, or that protective systems designed in accordance with this standard are used, and that no employees enter the excavations until protection is provided.      This employer has been cited for this practice that included: B & T Underground, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 679738, citation number 2, item number 3 and was affirmed as a final order on November 14, 2012, with respect to a workplace located at 1352 W. Diversey, Chicago Illinois 60639.     This employer has been cited for this practice that included: B & T Underground, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 92293, citation number 1, item number 3 and was affirmed as a final order on September 19, 2011, with respect to a workplace located at 1022 W. Diversey Parkway, Chicago Illinois 60613.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from excavation cave-ins.
