29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).    (a) North West Stair Tower -  Employees working from a supported scaffold were exposed to a fall of thirty three feet (33') to the ground below. The men were performing overhand bricklaying operations to construct the outer walls of the stair tower, a seven foot (7') wide opening for the window wall was not guarded and presented a falling hazard for the employees to the front, on or about March 11, 2014.    No abatement certification or documentation required.

29 CFR 1926.452(c)(2): Tubular welded frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which would have secured vertical members together laterally:    (a) Corridor 133 next to the Large Group Instruction Room- Employees performed overhand bricklaying work from a tubular welded frame supported scaffold that was 1 buck high.  The left section of scaffolding was constructed using only one set of cross braces.  This section of scaffolding was not attached to the scaffolding adjacent to it.  The men were exposed to a fall of approximately 5 feet 10 inches to the concrete floor below, on or about March 11, 2014.       Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.    (a) North West Stair Tower - An employee was observed accessing the top level of a two level scaffold by climbing the cross braces and end frame. The scaffold was not equipped with a scaffold ladder or equivalent system to provide a safe means of access/egress.  The employee was performing masonry work and was exposed to a fall of approximately 12 feet to the concrete landing of the stair tower below, on or about March 11, 2014.    (b) Corridor 133 next to Large Group Instruction - Employees accessed the walking platform of a one level scaffold by climbing the cross braces and end frames. The scaffold was not equipped with a scaffold ladder or equivalent system to provide a safe means of access/egress.  The employees were performing masonry work and were exposed to a fall of approximately 5 feet 10 inches to the concrete floor below, on or about March 11, 2014.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.    The employer TWK Construction Company Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 314164013, citation number 1, item number 1 and was affirmed as a final order on July 26, 2011, with respect to a workplace located at 1100 West Main Street Stroudsburg, PA 18360.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:  (a) Roof  - Employees climbed from a lower level roof to a higher roof using a shipping skid as a step.  The employees were working on the higher roof building the parapet on or about March 11, 2014.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
