29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants' chemical state and physical form:    a) Now or Never Trucking, Inc. at Booth State C36-79HZ, Kersey, CO 80644:  On or about March 3, 2014 the employer did not ensure that the workplace had been evaluated to assess employee exposures to respiratory hazards such as but not limited to hydrogen sulfide, benzene, xylene and toluene.  This condition exposed employees who perform tank gauging and hauling of crude oil to respiratory hazards associated with hydrocarbons.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.      a) Now or Never Trucking, Inc. at Booth State C36-79HZ, Kersey, CO 80644:  On or about March 3rd, 2014, employees gauging tanks and hauling crude oil were exposed to health and fire hazards associated with crude oil and hydrocarbons.  The employer did not develop and implement a written hazard communication program.  This condition exposed employees to chemical hazards.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:    a) Now or Never Trucking, Inc. at Booth State C36-79HZ, Kersey, CO 80644:  On or about March 3rd, 2014, employees gauging tanks and hauling crude oil were exposed to health and fire hazards associated with crude oil and hydrocarbons and the employer had not trained all employees to utilize tank bleeder valves to minimize or eliminate employee exposure to flammable vapors.  This condition exposed employees to chemical hazards.
