OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling stock.    a)  Warehouse:  On or about March 11, 2014 and at times prior, the employer failed to ensure that damaged metal storage racks were repaired or taken out of service until they could be repaired.  Visible damage by bent columns at the base of the racks, on both the salad dressing and oil rack storage racks.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.  a)    Back dock area; On or about March 11, 2014 and at times prior, the employer exposed employees to fire hazards in that employees were allowed to walk and work in the same area where oxygen cylinders and fuel gas cylinders used for welding (propane, acetylene) were stored together without a barrier as required by the standard.
