29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of copper dust listed in Table Z-1 in excess of the 8-hour Time Weighted Average concentration of 1.0 mg/m3:    a)  In the Grinding department, a grinder/buffer employee was exposed to copper dust at a level of 1.28 mg/m3 as an 8-hour time weighted average (TWA) on 4/15/2014, approximately 1.28 times the permissible exposure limit. This exposure was determined by air sampling conducted over 410 minutes during one shift, with zero exposure being assumed for the unsampled 70 minutes of an 8-hour work shift.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):    a)  In the Grinding department, a grinder/buffer employee was exposed to copper dust at a level of 1.28 mg/m3 as an 8-hour time weighted average (TWA) on 4/15/2014, approximately 1.28 times the permissible exposure limit. This exposure was determined by air sampling conducted over 410 minutes during one shift, with zero exposure being assumed for the unsampled 70 minutes of an 8-hour work shift.    Controls in these circumstances may include, but are not limited to, the following:    1)  Provide local exhaust ventilation. Local exhaust ventilation should have sufficient capture velocity to entrain dust created by the grinding/buffing operations at the point of generation.    2)  Provide a ventilated enclosure where dust and particulate from grinding/buffing operations are contained within the enclosure and removed by local exhaust ventilation.    3)  Monitor the air in this area to identify areas and times when contaminant levels are the highest, and to verify effectiveness of controls.    4)  Re-direct exhaust from pneumatic hand tools so as not to stir up settled dust into the employees' breathing zone. Enact a daily, or more frequent as necessary, housekeeping program to clean up fugitive dust on surfaces in work areas.

29 CFR 1910.94(b)(2): Where dry grinding, dry polishing or buffing was performed, and employee exposure, without regard to the use of respirators, exceeded the permissible exposure limits prescribed in 1910.1000 or other sections of this part, a local exhaust ventilation system was not provided and used to maintain employee exposures within the prescribed limits:    a)  On 4/15/2014, local exhaust ventilation was not provided when a grinder/buffer employee was exposed to copper dust at a level of 1.28 mg/m3 as an 8-hour time weighted average (TWA) while dry grinding, polishing and buffing.
