29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: (Construction Reference 1926.103) Employees were subject to inhalation hazards while performing construction/renovation activities in the Morgan Building on the Washburn University campus. Employees were not fit tested before using the N95, Model 8210 respirators.

29 CFR 1926.57(b): Local exhaust ventilation system(s) were not designed to prevent air contaminant(s) from being drawn through the work area of employee(s). In room 110 of Morgan Building on the Washburn University campus demolition and remodeling activities were being conducted. A portable, industrial grade air purifier was not adequately discharge to the outside atmosphere in that the flex duct exhaust line was draped through an open window extending approximately 14". The proximal windows were open allowing the exhaust to recirculate back into the work area
