OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employees in that employees working in the Mixing Feed Pro area were exposed to potential struck by hazards due to the load capacity of the spider bars had not been determined.    a) Manufacturing area, Mixing Feed Pro area hopper #7 - On March 12, 2014, the employer did not ensure the 39 inch by 39 inch spider lifting device used to lift the 1,200 kilogram PVC dust super sacks was not load rated, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its load.        b)  Manufacturing area, Mixing Feed Pro area hopper #8 - On March 12, 2014, the employer did not ensure the 39 inch by 39 inch spider lifting device used to lift the 1,200 kilogram PVC dust super sacks was load rated, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its load.     c)  Manufacturing area, Mixing Feed Pro area hopper #6 - On March 12, 2014, the employer did not ensure the 39 inch by 39 inch spider lifting device used to lift the 900-1,000 pounds of re-grind super sacks was load rated, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its load.     d)  Manufacturing area, Mixing Feed Pro area hopper #9 - On March 12, 2014, the employer did not ensure the 39 inch by 39 inch spider lifting device used to lift the 900-1000 pounds of re-grind super sacks was load rated, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its load.     e)  Manufacturing area, Mixing Feed Pro area hopper #10- On March 12, 2014, the employer did not ensure the 39 inch by 39 inch spider lifting device used to lift the 900-1,000 pounds of re-grind super sacks was load rated, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its load.

29 CFR 1910.23(a)(2): Every ladderway floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening.  a)  Mixing Tower, first level.  On March 12, 204 and at times prior to employees were exposed to a fall hazard when inspecting the cool mixers due to the ladderway opening not provided with a swing gate or so offset that a person cannot walk directly into the opening.
