29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s). The employer does not guard all the points of operation of machines whose operation exposes employees to injury. This violation occurred on or about March 10, 2014 in the fabrication area where employees were exposed to struck-by and caught-by hazards when operating two Jet Drill Presses without point of operation guarding. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the points of operation of machinery are guarded.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information. The employer does not provide the updated training according with the revised Hazard Communication Standard. This violation occurred on or about March 10, 2014, and at times prior thereto, when employees in the facility were required to handle hazardous chemicals without being trained on how to identify the hazards associated with those chemicals according with the revised Hazard Communication Standard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are trained on all hazards in their work area according with the revised Hazard Communication Standard.
