Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    On or about March 13, 2014 and times prior thereto, located at 6425 Hwy 126 N in Midway, Arkansas, an employee did not utilize personal protective equipment in the form of seatbelt when operating a Komatsu FG540.  Employee was exposed to the potential of being ejected or crushed by the forklift and/or materials.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:    On or about March 15, 2014 and times prior thereto, located at 6425 Hwy 126 N in Midway, Arkansas the employer required the use of respirators for employees to use when painting or applying coating to fabricated steel structures and/or parts.  The employer did not develop a written respiratory protection program that included specific work procedures.  Employees had potential exposure to chemical mists and vapors.

29 CFR 1910.134(h)(2)(i): All respirators shall be stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals, and they shall be packed or stored to prevent deformation of the facepiece and exhalation valve:  On or about March 15, 2014 and times prior thereto, located at 6425 Hwy 126 N in Midway, Arkansas respirators were not stored in a manner to protect them from damaging chemicals and dust.  The respirators were stored freely in a vented metal cabinet located in the painting area. Employees were potentially not protected from paint chemicals when using respirators with improperly stored cartridge filters.
