29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:    a) On or about 3/14/14, on construction site at 241 & 245 Lafayette Ave., Buffalo, NY: In order to access scaffolding set up in the basement foundation for the infirmary, employees on the ground level climbed up and over a 32 inch high wall, stepped down 10 in. onto a 6 in. wide ledge, then stepped down & across a 9 in. wide gap between the wall and the scaffold planking. No ladder or other safe means of access was provided.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): 29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigged support that will not deflect, and a grasping device was not provided to assist employees in mounting and dismounting the ladder:     a) On or about 3/14/14, on construction site at 241 & 245 Lafayette Ave., Buffalo, NY: In order to access scaffolding set up in the basement foundation for the infirmary, an 8 ft. Werner Stepladder was set up on basement floor with the ladders' steps parallel to the scaffold planks. Employees climbed up the ladder to the 6th step and had to step up approx. 14 inches and onto the overhanging ends of the scaffold planks. The actual top of the stepladder was only about 8 inches above the planking and no grasping device was provided. It is also prohibited to step on the top or top step of a stepladder.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On or about 3/14/14, on construction site at 241 & 245 Lafayette Ave., Buffalo, NY: Employee engaged in construction work was not trained to recognize potential hazards on this type of jobsite including but not limited to falls from walls, ladders, & scaffolds, machine guarding hazards, electrical hazards, and other hazards associated with masonry work. Employee was also not trained in the applicable OSHA regulations to control or eliminate these hazards.    ABATEMENT CERTIFICATION REQUIRED
