On or about March 17, 2014, at the above addressed jobsite, employees utilized a needle gun to conduct power tool cleaning on a bridge coated with lead based paint.  Employees conducting the power tool cleaning used half face respirators when a minimum of full face respirators were required, thereby exposing employees to hazards associated with lead.

29 CFR 1910.134(g)(1)(i)(A): Procedures for proper use of respirators not implemented which allowed facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function;   a.  On or about March 17, 2014, at the above addressed jobsite, employees utilized a needle gun to conduct power tool cleaning on a bridge coated with lead based paint.  The employer failed to implement a respiratory protection program which included, but was not limited to proper use of respirator, thereby exposing employees to lead hazards.  Employees were allowed to wear tight fitting respiratory protection with facial hair.

29 CFR 1926.152(a)(1): Only approved containers and portable tanks shall be used for storage and handling of flammable and combustible liquids. Approved safety cans or Department of Transportation approved containers shall be used for the handling and use of flammable liquids in quantities of 5 gallons or less, except that this shall not apply to those flammable liquid materials which are highly viscid (extremely hard to pour), which may be used and handled in original shipping containers. For quantities of one gallon or less, the original container may be used, for storage, use and handling of flammable liquids.     a.  On or about March 17, 2014, at the above addressed location, employees were exposed to hazards associated with flammable liquids.  Methyl ethyl ketone, a flammable liquid, was transported in an ordinary 5 gallon bucket without a lid which was not approved for handling and storing flammable liquids.
