29 CFR 1926.404(b)(1)(i): General. The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors.    location: interior of building, lot 21-22  on or about: 03/13/14    a) Employees were using equipment, including a Makita sander, that were plugged into extension cords.  The employees were not provided with GFCI protection or an assured equipment grounding conductor program.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems:    location: 3rd floor, lot 21-22    a) Employees, installing the permanent stairrail and hallway banister, were not provided with any means of fall protection. The employees were exposed to a fall of 10 1/2 feet.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one stairrail system along each unprotected side or edge:  location: stairs between 1st and 3rd floors, lot 21-22 on or about: 3/13/14   a) Employeee were using the stairs to access the upper levels and were working from the stairs while installing the permanent stairrails. The open sided stairs were not provided with temporary stairrails.
