OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards from a leaking natural gas line while working in a confined space: a) Construction site - On or about March 13, 2014, an employee entered the remains of basement that met the definition of a confined space. Entry was made without a survey and identification by a qualified person, evaluation of potential hazards, utilization of a flammable gas meter to test the atmosphere, or provision for emergency evacuation or rescue. Among other methods, feasible and acceptable means of abatement would be to comply with ANSI/ASSE Z117.1-2009 Safety Requirements for Confined Spaces, Sections 3, 6, 7, and 14; and compliance with Geppert Brothers, INC. written Confined Space Entry Procedures.

29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required a) Construction site - On or about March 13, 2014, an employee entered the remains of basement meeting the definition of a confined space, without having been properly trained in recognition and mitigation of potential hazards of confined space entry.
