OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer used PVC pipe to supply compressed air not in accordance with manufacturer specifications, exposing employees to struck-by hazards.       a) Compressed air used with Poly Vinyl Chloride (PVC) pipe throughout shop area - On or about, and at times prior to March 11, 2014,  employees used compressed air to supply air to pneumatic hand tools, and service tires.  The compressed air was transported through ¾-inch schedule 40, polyvinyl chloride (PVC) pipe, not in accordance with manufactures safe use, exposing employees to struck-by and laceration hazards.           ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.177(c)(1)(i): The employer shall assure that no employee services any rim wheel unless the employee has been trained and instructed in correct procedures of servicing the type of wheel being serviced, and in the safe operating procedures described in paragraphs (f) and (g) of this section.    a)  Tire shop area - On or about, and at times prior to March 11, 2014, the employer did not establish a tire training program that was inclusive of information contained in rim charts or rim manuals, exposing employees struck-by hazards. 29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   a) Throughout the facility - On or about, and at times prior to March 11. 2014, the employer failed to develop, implement and maintain at its workplace a written hazard communication program, containing at least how relevant information about material data sheets, warning labels and training that met the minimum safety requirements for handling chemicals such as, but were not limited to oils, paints, parts cleaners, and  aerosols, exposing employees to chemical hazards.
