29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard: (a) Facility: On or about March 18, 2014, an employee was working from an open sided platform at the cinder box. This open side was between the platform and the cinder box. The fall hazard to the employee was approximately 56 inches.

29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board: (a) Facility: On or about March 18, 2014 the top of the cinder box was only 35 inches above the steel grating platform that employees work from. At the bottom and in the middle of this cinder box there is a revolving steel tracked conveyor.
