OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being ejected or falling from the operators seat: a) Worksite - On or about March 24, 2014, the employee was observed operating the forklift without utilizing the provided seat belt. ABATEMENT NOTE: Among other methods, one acceptable means of abatement would be to require the use of the seat belt in accordance with the Consensus Standard ANSI/ITSDF Safety Standard for Low and High Lift Tucks B56.1-2005, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used.
