29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Laborer - an employee was exposed to continuous noise levels at 108% of the allowable 8-hr time-weighted average level (TWA) or an equivalent level of approximately 90.6dBA. The sampling was conducted for 444 minutes during one shift on March 26, 2014. Zero exposure is assumed for the unsampled time of 36 minutes. b) Laborer - an employee was exposed to continuous noise levels at 110% of the allowable 8-hr time-weighted average level (TWA) or an equivalent level of approximately 90.7dBA. The sampling was conducted for 442 minutes during one shift on March 26, 2014. Zero exposure is assumed for the unsampled time of 38 minutes. c) Laborer - an employee was exposed to continuous noise levels at 67% of the allowable 8-hr time-weighted average level (TWA) or an equivalent level of approximately 87.1dBA. The sampling was conducted for 443 minutes during one shift on March 26, 2014. Zero exposure is assumed for the unsampled time of 37 minutes.
