29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met  a) On or about March 21, 2014, Social Security Administration (SSA) employees, while working at the SSA facility located at 3504 Cumberland Ave in Middlesboro, KY, were exposed to cleaning chemicals and did not have a written hazard communication program available at the worksite.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not comply a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.  a) On or about March 21, 2014, Social Security Administration (SSA) employees, while working at the SSA facility located at 3504 Cumberland Ave in Middlesboro, KY, were exposed to cleaning chemicals in which the employer did not develop a complete inventory of hazardous materials currently being used in the work area.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical.   a) On or about March 21, 2014, Social Security Administration (SSA) employees, while working at the SSA facility located at 3504 Cumberland Ave in Middlesboro, KY, were exposed to chemicals (to include but not limited to Hillayrd Top Clean, Sherwin Williams paint and varnish, Bleach, various air fresheners, window cleaner, and carpet cleaners) and the employer did not maintain and make available Safety Data Shees (SDS's) for for these products.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv).  a) On or about March 21, 2014, Social Security Administration (SSA) employees, while working at the SSA facility located at 3504 Cumberland Ave in Middlesboro, KY, were exposed to cleaning chemicals (to include but not limited to Hillayrd Top Clean, Sherwin Williams paint and varnish, Bleach, various air fresheners, window cleaner, and carpet cleaners) and did not provide employees information/training on hazardous chemicals used in the work areas..
