29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: (a) At a Bulgar Stucco construction site on or about March 24, 2013 employees worked from a Skyjack SJ45T 4X4 aerial lift without attaching the body belts.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service: (a) The personal fall arrest harness was showed extensive fraying and deteriation, and had not been removed from service. (b) The lanyard used did not have a locking mechanism that would prevent roll out and did not have a shock pack to slow decent if the user fell.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used: (a) The personal fall arrest harness was showed extensive fraying and deteriation, and employees did not know to inspect the harness and remove it from service. (b) One of the lanyards used did not have a locking mechanism that would prevent roll out and did not have a shock pack to slow decent if the user fell, and employees did not know that it was not safe and that it should be removed from service. (c) The selection of the full body harness with a six foot lanyard did not provide an effective form of fall protection for the height that workers were working. The employees had not been trained on the effective height of their fall protection equipment and did not know that their fall protection would not prevent them from striking the ground if they fell. (d) Employees had not been trained on how to attach the lanyard to the harness when not needing to use the harness for fall protection. Attaching the hook to the front cross strap created a tripping hazard and damaged the harness. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
