29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Worksite, 30 West Main St. , Oyster Bay, NY- Employee was not wearing head protection and was exposed to being struck by tools and siding panels while working on a ladder directly below overhead work; on or about 3/25/14.    b) Worksite, 30 West Main St., Oyster Bay, NY- Employee was not wearing head protection and was exposed to being struck by tools and siding panels while working on the ground directly on a ladder below overhead work; on or about 3/25/14.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

All woodworking tools and machinery shall meet other applicable requirements of American National Standards Institute, 01.1-1961, Safety Code for Woodworking Machinery:    a) Workplace, 30 West Main St., Oyster Bay, NY- Employee was cutting wood materials using a DeWalt electric cut off saw with a 12" blade that had no guard; on or about 3/25/14.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
