OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards due to leaking process piping while operating kettle #2 in the grease department. a. Fiske Brothers Refining Company dba Lubriplate Lubricants located in Toledo, Ohio: On or about March 26, 2014, employees were exposed to fire and explosion hazards while operating kettle #2 in the grease department due to leaking process piping in the firebox under the kettle. Among other methods, feasible methods to correct this hazard would be to comply with American Petroleum Institute (API) 570 (November 2009 ed.) Piping Inspection Code: In-Service Inspection, Rating, Repair, and Alteration of Piping systems to ensure routine nondestructive testing and inspection is performed on the piping leading from the process kettles, to identify damage to the equipment, and provide necessary repair or replacement. Amended from 5a1 to 1910.39(c)(3): A fire prevention plan did not include procedures for regular maintenance of safeguards installed in heat-producing equipment to prevent the accidental ignition of combustible materials: a) Firske Brothers Refining Company dba Lubriplate Lubricants located in Toledo, Ohio: On or about march 26, 2014, the employer did not have inspection procedures in place for the draw-off pipe in the firebox under kettle #2.
