This violation was observed on or about March 25, 2014, on the south and east side of a single family dwelling where employees were exposed to a struck-by hazard when applying stucco cement from a set of fabricated frame scaffolds without wearing protective helmets when work was performed over their heads. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in areas where there is possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are protected by protective helmets.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. The employer does not protect each employee on a scaffold from falling objects. This violation was observed on or about March 25, 2014, on the south and east side of a single family dwelling where employees were exposed to a struck-by hazard when applying stucco cement from a set of fabricated frame scaffolds without toeboards or means to prevent objects from falling. Pursuant to C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold is provided with additional protection from falling hand tools, and other small objects through the of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.

Cross braces were used as a means of access. The employer does not ensure that a ladder or other means of access is provided for scaffolding. This violation was observed on or about March 25, 2014, on the south and east side of a single family dwelling where employees were exposed to 6 and 12 feet fall hazards when accessing fabricated frame scaffolding without a safe means of access. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that platforms 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface is used.
