29 CFR 1926.151(a)(3): Smoking was not prohibited at or in the vicinity of operations which constituted a fire hazard:(a)LOCATION, DESCRIBE CIRCUMSTANCES WHICH SHOW THAT SMOKING WAS NOT PROHIBITED, SUCH AS THE PRESENCE OF ASH TRAYS, ETC., CONDITIONS CAUSING THE FIRE HAZARD) (a) At the Northeast of lumber yard, the employer did not prohibit employees from smoking near combustibles such as plywood's at approximately 10 1/2 feet where cigarette filters were present, exposing employees to fire hazards. (b) At the South end of the GC's stair to main entrance, the employer did not prohibit employees from smoking near combustibles such as the office trailer at approximately 4 inches where cigarette filters were present, exposing employees to fire hazards. (c) At the North side of the GC's office, the employer did not prohibit employees from smoking near combustibles such as the office trailer at approximately 1 1/2 feet where cigarette filters were present, exposing employees to fire hazards. (d) At the West side of the office trailer, the employer did not follow the No Smoking sign by smoking near combustibles such as the office trailer less than 50 feet away, exposing employees to fire hazards.
