29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: (a) Jobsite, Crimson Cafe, Indiana, PA: On or about 03/24/14 an employee was working in an aerial lift without wearing a harness and lanyard attached to the boom or basket. The employee was positioned approximately 13 feet above the ground working in the aerial lift taking measurements and was not protected from falling by the use of fall protection.

29 CFR 1926.454(c)(3): Retraining will be conducted where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency: [61 FR 46025, Aug. 30, 1996] (a) Jobsite, Crimson Cafe, Indiana, PA: On or about 03/24/14 retraining was not conducted for an employee who was working in an aerial lift without utilizing the proper fall protection indicating the employee had not retained the requisite proficiency involving scaffold safety and use.
