29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abetment of citation 1 item 2 in which employees not wearing fall protection, were exposed to fall hazards of up to approximately 16 feet to the ground surface below when performing framing, sheathing installation, and other related activities from the upper floor of a new residential structure.  These employees had not received fall protection training from the company.  Condition observed on or about 05/07/14.

Condition observed on or about 03/25/14.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a- Lot 10, Block 13, Lakewood NJ: Employees, not wearing fall protection, were exposed to fall hazards of up to approximately 16 feet to the ground surface below when performing framing, sheathing installation, and other related activities from the upper floor of a new residential structure.  These employees had not received fall protection training from the company.  Condition observed on or about 03/25/14.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a- Lot 10, Block 13, Lakewood NJ: Employees were exposed to fall hazards, of up to approximately 16 feet to the ground surface below, when accessing and egressing an upper working/walking surface from a ladder whose side rails did not extend this surface three feet.  Condition observed on or about 03/25/14.
