OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation and crushing hazards when working in an elevated platform on the forks of a material handling powered industrial truck that did not have protection against the moving parts of the mast. Warehouse Area. Employee(s) stood on a platform elevated on the forks of a material handling powered industrial reach truck in order to retrieve product that had slipped from pallets on the racks. The platform was deficient in that it did not have adequate guarding to protect employees from getting caught in the moving parts of the mast. There is no abatement documentation or certification required for this item.

29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, and the brakes set to prevent movement: Warehouse Area. While an employee was elevated in a platform on the forks of a powered industrial reach truck approximately 6 feet high, the operator of the truck left the vehicle unattended. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
