29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 100.9.  That same worker was exposed to a peak noise of 126.8 decibels. Monitoring had not been conducted to determine worker exposure and audiometric testing was not performed prior to the worker starting work and annually thereafter.    (b) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 103.2.  That same worker was exposed to a peak noise of 131.8 decibels.  Monitoring had not been conducted to determine worker exposure and audiometric testing was not performed prior to the worker starting work and annually thereafter.    (c) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 96.4.  That same worker was exposed to a peak noise of 114.8 decibels.  Monitoring had not been conducted to determine worker exposure and audiometric testing was not performed prior to the worker starting work and annually thereafter.    (d) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 97.5.  That same worker was exposed to a peak noise of 117.5 decibels.  Monitoring had not been conducted to determine worker exposure and audiometric testing was not performed prior to the worker starting work and annually thereafter.    (e) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 93.7.  That same worker was exposed to a peak noise of 116 decibels.  Monitoring had not been conducted to determine worker exposure and audiometric testing was not performed prior to the worker starting work and annually thereafter.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  (a) At Osage Canoes LLC on or about July 7, 2014 workers were exposed to noise levels that prevented normal conversation resulting from the use of impact tools and the operation of presses.  The employer had not developed and implemented a monitoring program.  Five workers were sampled by OSHA for noise exposure and all five were found to have exposure average exposure levels greater than 90 decibels as measured on the "A" scale.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    (a) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 100.9.  That same worker was exposed to a peak noise of 126.8 decibels. Audiometric testing was not performed prior to the worker starting work and annually thereafter.    (b) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 103.2.  That same worker was exposed to a peak noise of 131.8 decibels.  Audiometric testing was not performed prior to the worker starting work and annually thereafter.    (c) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 96.4.  That same worker was exposed to a peak noise of 114.8 decibels.  Audiometric testing was not performed prior to the worker starting work and annually thereafter.    (d) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 97.5.  That same worker was exposed to a peak noise of 117.5 decibels.  Audiometric testing was not performed prior to the worker starting work and annually thereafter.    (e) At Osage Canoes LLC on or about July 7 and 8, 2014 employees were exposed to noise levels exceeding the 8-hour time-weighted average sound level of 85 decibels measured on the A scale.  Sampling conducted by OSHA showed one worker exposed at a TWA of 93.7.  That same worker was exposed to a peak noise of 116 decibels.  Audiometric testing was not performed prior to the worker starting work and annually thereafter. 29 CFR 1910.95(j)(1): The employer did not evaluate hearing protector attenuation for the specific noise environments in which the protector will be used and use one of the evaluation methods described in Appendix B: Methods for Estimating the Adequacy of Hearing Protection Attenuation:    (a) At Osage Canoe LLC on or about July 7 and 8, 2014 the hearing protection attenuation for the hearing protection used by employees had not been evaluated following the methods described in Appendix B or other acceptable means to determine the adequacy of the hearing protection attenuation.  Osage Canoe had not evaluated the hearing protection to determine if the hearing protection was suitable for the environment where the hearing protection was worn.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1910.307(g)(2)(i): Locations were not classified depending on the properties of the flammable vapors, liquids, or gases that may be present and the likelihood that a flammable or combustible concentration or quantity could be present:    (a) At Osage Canoes, LLC on or about July 7, 2014 workers used paint solvents and painted in an area that did not conform to the provisions of subpart S of this part for Class I, Division 2 Hazardous Locations.    (b) At Osage Canoes, LLC on or about July 7, 2014 workers used fans not designed for Class I, Division 2 Hazardous Locations to blow solvents away from the workers faces who were prepping and painting canoes.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
