29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: On or about March 28, 2014, and at times prior thereto, the employer did not ensure two employees who were cutting and installing decking using a Makita Circular 7-1/4 Saw and a Hitachi NR 83A2, ST Air Nail Gun were provided with eye protection exposing the employees to eye and face injuries.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): On or about March 28, 2014, and at times prior thereto, two employees installing decking on the roof of a residential construction project were not provided with fall protection exposing the employees to fall hazards of approximately (9) feet to the ground below.
