29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  (a) Boyer Nursery and Orchard - Employees use tools, machinery and equipment in the orchards and around the company buildings including pesticide application and operating chain saws.  The employer did not prepare a certification of hazard assessment on or about March 28, 2014.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (Agriculture Reference: 1928.21(a)(5))  (a) Boyer Nursery and Orchard - The employer did not develop or implement a written hazard communication program which described how the requirements for chemical labels and other forms of warning, safety data sheets, and employee information and training will be met, on or about March 28, 2014.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv):   The employer did not produce a hazard communication program that included an explanation of the labels received on shipped containers and the workplace labeling system used by their employer and the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  (Agriculture Reference: 1928.21(a)(5))  (a) Boyer Nursery and Orchard - The employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively on or about March 28, 2014.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
