OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working out of the basket of a scissors lift.  The employer is failing to protect employees from potential fall hazards associated with employees working out of the basket of a scissors lift while on an incline at a height of 18' 6".  The most recent example of this was found on the job site located at 4403 S 139th Street, Omaha, NE 68114 where an employee was working out of the basket of a scissors lift with the basket extended to 18' 6" and the wheels were on an incline of 5.2 % from a level surface.  The scissors lift tipped over causing the employee in the basket to receive serious injuries from the fall.  Among methods feasible and acceptable method(s) of abatement are:  1.  The employer needs to ensure that all employees are aware of the requirements to use the scissors lift on a firm, flat, smooth, and level surface per the requirements of the manufacturer found in the Equipment Manufacturers Institute (EMI) page 25, Safety-During Operation.
