29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition: a) There was dust and dirt buildup above the exit tunnel to present a potential fire hazard. b) The electrical junction box on the wall of tunnel had approximately 4" of dust and dirt on top of it with an open hole in the box. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards: Note: Toe boards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard: a) The BMD pouring deck chains were not in place to protect employees from approximately a 7' fall hazard. b) The BMD Junker deck chains were down, along with a removable section of guardrail, exposing employees to an approximately 8' fall hazard. c) There was a 13" gap in railing for the auger platform that ran to the south from the east/west platform. There was a fall hazard of approximately 12'. d) Augers were only 18" to 22" in height exposing employees to a 12' fall hazard from the last west platform. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Guarding was not provided to protect employees from the rotating patterns in a 30" wide by 24" opening in the fence. Nip point was approximately 13" inside of the opening on the right and 19" on the left. Both the west and east sides of the equipment had these openings. b) The guard chains were not in place along the pattern conveyor line. c) The last west auger platform did not have the covers secured on all of the augers. d) The pelletizer conveyor belt nip points were not guarded. Additional conveyors on multiple levels of the building also had nip points that needed guarding which included conveyors 207, 209, and 216. e) The BMD blast basement gate needed additional guarding to prevent entry during operation. ABATEMENT CERTIFICATION REQUIREED

29 CFR 1910.157(c)(4): Portable fire extinguishers were not kept in their designated places at all times except during use: a) In the BMD area a fire extinguisher was missing from the designated hanger for two days. The extinguisher was removed for use on an incipient stage fire in another area of the plant.
