29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part. a) The employer was unable to produce any written safety and health management programs or accident prevention programs when asked to see them for review on March 31, 2014 at the construction job site. The employer had no further explanation what his programs consisted of if he did not have programs in writing.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) On or about March 31, 2013 at the Best Western Plus Park Inn at 3291 State Route 9, Saratoga Springs, NY 12886 the employer did not ensure that the employees involved with the siding construction and setting up for the siding construction were wearing safety glasses and the person involved as the ground person was not wearing head protection.
