29 CFR 1910.176(a): Where mechanical handling equipment was used, aisle(s) and passageway(s) were not kept clear and in good repair with no obstruction across or in aisles that could create a hazard. On or about March 31, 2014, and times prior thereto, aisle(s) and passageway(s) were not kept in good repair: a) The loading dock pavement had uneven surfaces ranging from one-half inch up to three inches lower than adjacent pavement surfaces. b) At the overhead door to the Feed Barn, metal grating covering drainage containment had broken sections which also allowed for the grating to shift easily. This exposed forklift operators to struck-by hazards in the event of falling material and/or forklift tip-over hazards.

On or about March 31, 2014, and times prior thereto, forklift operators were required to stack pallets of heavy merchandise on a steel racking system of which the load capacity was not displayed on the racking system, exposing the operators to struck-by hazards and/or caught-in/between hazards in the event of falling merchandise or collapsing racking system.

On or about March 31, 2014, the emergency exit door located in the Feed Barn was locked and blocked by palletized merchandise, exposing employees to fire and/or other emergency evacuation-related hazards. Atwoods was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.36(b)(1), which was contained in OSHA inspection number 314933326, citation number 1, item number 4, and was affirmed as a final order on January 9, 2012, with respect to a workplace located at 716 West Ayre, Shawnee, Oklahoma 74801.
