29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) On or about April 1, 2014 in Saratoga Springs, NY at the corner of East Avenue and Excelsior Avenue protective eyewear was not worn by an employee exposing the employee to possibly being struck in the eye and incurring an eye injury.

29 CFR 1926.150(c)(1)(viii): Portable fire extinguishers were not inspected periodically in accordance with maintenance and use of portable fire extinguishers, N.F.P.A. No. 10A-1970: (a) On or about April 1, 2014 the tag on the ABC fire extinguisher in the construction work truck license number 67966 parked at the job site at the corner of East Avenue and Excelsior Avenue, in Saratoga Springs, NY read July 2009 and was not current in accordance with the interval spelled out in chapter 3 of NFPA No. 10A-1970 which indicated that this inspection was not to exceed one year. Accordingly this expired fire extinguisher exposed employees to a burn hazard if they needed to use the fire extinguisher and it did not function properly.
