OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:   a)  In the facility yard, on or about April 1, 2014 and at times prior to, an employee was operating a Genie Telehandler forklift without utilizing the manufacturer installed seat belt, resulting in a struck-by hazard.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (a) Throughout the facility yard, on or about April 1, 2014 and at times prior to, the employer did not provide basic advisory information contained in Appendix D to employees who used filtering facepiece respirators on a voluntary basis, resulting in a respiratory and dermal hazard.
