29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  a) In front of restaurant, 80 South Wyoming Avenue, Kingston, PA: An employee was working in an aerial lift basket without the use of any personal fall protection systems. The employee was exposed to a fall hazard of approximately twenty three-foot, eight-inches (23'8") from the basket onto a concrete sidewalk, as observed on or about April 2, 2014.  In accordance with 29 CFR 1903.19, abatement certification and documentation is not required for this violation as abatement was observed during the inspection.

29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket: a) In front of restaurant, 80 South Wyoming Avenue, Kingston, PA: An employee was working in an aerial lift basket while placing one leg on the top of the basket. The employee was exposed to a fall hazard of approximately twenty three-foot, eight-inches (23'8") from the basket onto a concrete sidewalk, as observed on or about April 2, 2014. In accordance with 29 CFR 1903.19, abatement certification and documentation is not required for this violation as abatement was observed during the inspection.

29 CFR 1926.453(b)(2)(viii): An aerial lift truck was moved when the boom was elevated in a working position with men in the basket and was not specifically designed for this type of operation in accordance with the provisions of paragraphs (a)(1) and (2) of this section.  a) In front of restaurant, 80 South Wyoming Avenue, Kingston, PA: A truck (PA License Plate ZDE-0212) with an employee elevated in the mounted Telsta Aerial Lift Boom basket was moved from the parking lot, over a curb, and onto a concrete sidewalk. The employee was exposed to a fall hazard of approximately twenty three-foot, eight-inches (23'8") onto the concrete sidewalk, as observed on or about April 2, 2014.  In accordance with 29 CFR 1903.19, abatement certification and documentation is not required for this violation as abatement was observed during the inspection.
