29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On third street in Sugar Grove, employees were working in a straight cut trench at 6 feet in depth with a ladder for egress however the ladder was not positioned in a manner that would allow the employee to exit the trench safely. The employee was exposed to a caught in hazard.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. a. On third street in Sugar Grove, the employer was using a ladder for entry and egress from a six foot trench. The shielding extended three feet above the street surface resulting in a break in elevation of greater than 19 inches to access and egress on the ladder, thereby exposing employees to a fall hazard.

On third street in Sugar Grove the employer had opened a trench in the roadway and blocked the other lane with the spoil pile effectively closing the street to traffic. The employer failed to put up a road closed sign to notify motorists that the street was not accessible.
