29 CFR 1910.23(a)(5): Every pit and trapdoor floor opening, infrequently used, shall be guarded by a floor opening cover of standard strength and construction. While the cover is not in place, the pit or trap opening shall be constantly attended by someone or shall be protected on all exposed sides by removable standard railings. a. At the work site, employees repaired automobiles in the north bay where there was a fluid-filled pit covered by an unsecured piece of plywood, supported from underneath by three strips of wood, one of which was broken. The employer had not ensured that the pit was adequately guarded by a cover of standard strength and construction.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a. At the work site, employees serviced and repaired vehicles in two bays that each held two cars. The employer had not performed a job hazard assessment to determine if hazards were present that could harm employees and if personal protective equipment should be used.

At the work site, employees serviced vehicles and used chemicals that included (but were not limited to) Valvoline Premium Conventional 5W-20 motor oil, Valvoline Premium Conventional 5W-30 motor oil, transmission fluid, brake fluid, power steering fluid and BP Blast spray lubricant. The employer did not have a written hazard communication program for employees.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a.
