29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a.  On or about April 2, 2014 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a. On or about April 2, 2014 - at the above addressed jobsite, the employer failed to provide a training program for each employee who might be exposed to fall hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     a.  On or about April 2, 2014 - at the above addressed jobsite, an employee performing carpentry framing operations from a deck, more than six (6) feet above the ground was not protected from a fall, thereby exposing the employee to fall hazards.
