29 CFR 1926.1101(k)(9)(i): The employer did not institute, at no cost to employees, a training program for each employee who was likely to be exposed in excess of the permissible exposure limit (PEL) and for each employee who performed Class I through IV asbestos operations:    (a) On or about March 31, 2014, on the second floor of the Sears Department Store near the stock rooms, in an area partitioned off with plastic of approximately 56 feet long by 24 feet wide, tile and mastic containing 2% Chrysotile asbestos was removed by two workers using a Terminator 2100 ei floor stripper machine without established containment. The workers had not been trained per the requirements of 1926.1101(k)(9)(iv)(A) to perform Class II work.   (b) On or about March-April 2014, at the Sears Department Store on the first and second floors, for laborers, carpenters and electricians performing renovation work such as but not limited to ripping up carpets, removing and adding fixture walls, running conduit, and replacing and installing new drop ceilings in areas near asbestos containing materials such as elbows and floor tiles.
