OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by fragments of polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:    a)  8 Powell Circle, Ariton, AL 36311; On or about April 1, 2014 and at times prior thereto, the employer exposed employees to the hazard of being struck-by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:  Shop Areas - PVC plastic piping was used in exposed above ground locations to transport compressed air at 115 psi exposing employees to struck-by hazards from shards of PVC if the pipe ruptures or explodes.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:  a)  Paint Area; On or about April 1, 2014 the employer exposed employees to fall hazards in that employees were allowed to walk and paint on a large furnace frame 9 foot 6 inches above the next lower level that did not have a standard handrail or other means of fall protection.

29 CFR 1910.213(c)(1): Circular handfed ripsaw(s) were not guarded by an automatically adjusting hood which completely enclosed that portion of the saw above the table and above the material being cut:     a)  Shop; On or about April 1, 2014 and at times prior thereto, the employer exposed employees to amputation hazards in that employees were allowed to operate a Ryobi 10" table saw without a guard in place that had an automatically adjusting hood and completely enclosed the portion of the saw above the table and above the material being cut as required by the regulation.
