29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):    (a)Delt Services, LLC at 5131 Franklin Street, Denver, CO 80204:  On and before April 3rd, 2014, the employer did not establish a program consisting of an energy control procedures and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative, including but not limited to the following:      (1)  Elevator  (2)  Electrical panels  (3)  Plant transport/potting conveyor and machine      Abatement Note:  As part of an energy-control program, employers must:      (1) Establish energy-control procedures for removing the energy supply from machines and for putting appropriate lockout or tagout devices on the energy-isolating devices to prevent unexpected reenergization.  When appropriate, the procedure also must address stored or potentially reaccumulated energy.      (2) Train employees on the energy-control program, including the safe application, use, and removal of energy controls; and      (3) Inspect these procedures periodically (at least annually) to ensure that they are being followed and that they remain effective in preventing employee exposure to hazardous energy.      The energy-control procedures must outline the scope, purpose, authorization, rules, and techniques that employees will use to control hazardous energy sources, as well as the means that will be used to enforce compliance.  These procedures must provide employees at least the following information:      (1)  A statement on how to use the procedures;      (2)  Specific procedural steps to shut down, isolate, block, and secure machines;    Outside personnel (contractors, etc.)      (1) Whenever outside servicing personnel are to be engaged in activities covered by the scope and application of this standard, the on-site employer and the outside employer shall inform each other of their respective lockout or tagout procedure.    (2)  The on-site employer shall ensure that  his/her employees understand and comply with the restrictions and prohibitions of the outside employer's energy control program.

29 CFR 1910.215(a)(4): Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:    (a)Delt Services, LLC at 5131 Franklin Street, Denver, CO 80204: On and before April 3rd, 2014, the employer did not ensure that the 6" Ryobi bench grinder (BGH6110) had a properly installed work rest.  Employee uses the bench grinder to fabricate "all thread."  A work rest is required to support work and be adjustable to compensate for wheel wear.  A work rest shall be kept with a maximum opening of 1/8" to prevent work from being jammed between the wheel and rest, which may cause wheel breakage. This condition exposed employees to wheel breakage and possible projectiles which may cause struck-by hazards.

29 CFR 1910.305(a)(2)(ix): All lamps for general illumination were not protected from accidental contact or breakage by a suitable fixture or lamp holder with a guard:     (a)Delt Services, LLC at 5141 Franklin St., Denver, CO 80204: On and before April 3rd, 2014, the employer did not ensure that the 1000w metal halide lamps located throughout the facility were effectively covered as to prevent shattering and discharge of the outer jacket of the arc tubes due to extremely high temperatures (as high as 1832 degrees F, 1000 degrees C). The arc tubes can rupture unexpectedly due to internal causes or external factors. If the outer jacket of the lamp shatters, the hot quartz arc tube particles and outer jacket glass particles will be discharged and projected on to employees working in close proximity. The condition exposes employee to a struck-by and burn hazards associated with the discharge of hot projectiles.

29 CFR 1910.307(c)(2)(i): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:    (a)Delt Services, LLC at 5131 Franklin Street, Denver, CO 80204:  On and before April 3rd, 2014, the employer did not ensure that the duplex outlets, quad outlets and ceiling lights (Yampa Series with gasket enclosure) located within the hash oil extraction room and adjacent to the butane extraction process, were approved for a Class 1 Division II location. This condition creates an explosion hazard due to the potential for an ignition source in a room where butane is utilized in the extraction process.    (b)Delt Services, LLC at 5131 Franklin Street, Denver, CO 80204:  On and before April 3rd, 2014, the employer did not ensure that the Caresaver Universal Refrigerant Recovery Unit located within the hash oil extraction room and adjacent to the butane extraction process, were approved for a Class 1 Division II location. This condition creates an explosion hazard due to the potential for an ignition source in a room where butane is utilized in the extraction process.

This condition exposes employees to fire, natural disasters, weather or other hazards that may require a coordinated response to an emergency to prevent physical injuries.     Abatement Note: Minimum elements of an emergency action plan. An emergency action plan must include at a minimum:     (1)Procedures for reporting a fire or other emergency;  (2)Procedures for emergency evacuation, including type of evacuation and exit route assignments;  (3)Procedures to be followed by employees who remain to operate critical plant operations before they evacuate;  (4)Procedures to account for all employees after evacuation;  (5)Procedures to be followed by employees performing rescue or medical duties; and  (6)The name or job title of every employee who may be contacted by employees who need more information about the plan or an explanation of their duties under the plan.
