OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, at the Spanish Trail Battery 8, on April 4, 2014, employees were exposed to fire hazards while performing maintenance activities on an operating 4 ft. X 20 ft. heater treater.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: Spanish Trail Battery 8: On April 4, 2014 the employer did not ensure that a program consisting of an energy control procedure, employee training and periodic inspections was implemented before employees replaced a valve assembly on a 4' X 20' heater treater. This condition exposed employees to fire and burn hazards.
