OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)  On or about March 12, 2014, and at times prior, employees were exposed to falls because the employer did correctly use the mobile ladder stand that was used to access the mezzanine storage level above the offices.  Employees placed the mobile ladder parallel to the wall and exited it from the side, going under rails to step onto the upper floor.

29 CFR 1910.24(b): Fixed stairs were not provided for access from one structure level to another where operations necessitated regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations:  a)  On or about March 12, 2014, and at times prior, employees were exposed to falls because the employer did not provide fixed stairs that would allow safe access to the mezzanine storage level above the offices.  Employees routinely accessed this level to store and retrieve packaging materials by incorrectly using a portable staircase.

29 CFR 1910.23(c)(1):  Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:     a)  On or about March 12, 2014, and at times prior, employees were exposed to fall hazards of greater than 4 feet when they worked on and around the storage area above the offices in the main shop because this level was not equipped with standard railings.  A top rail had been constructed, but the rail system was missing a standard mid rail.

29 CFR 1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:       a)  On or about March 12, 2014, and at times prior, employees were exposed to eye injuries while they used corrosive chemicals such as Lysol toilet cleaner to remove baked-on decals from vaporizers without access to a suitable eyewash facility in the immediate area.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   On or about March 12, 2014, and at times prior, the employer did not establish a written respiratory protection program and provide training to employees who voluntarily used elastomeric half-face respirators.  to protect themselves from asbestos fibers while cutting pipe which contained asbestos.  At least one employee used this type of respirator without being provided a medical evaluation and basic training in respirator use, cleaning, storage and maintenance which ensured that the use of the respirator itself did not present a health hazard.
