OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while conducting masonry activities from the elevated bucket of a New Holland C232 skid steer. On or about April 8th, 2014, at a jobsite located at 10235 N. Port Washington Rd., in Mequon, Wisconsin, the employer did not ensure that two employees were protected from a fall hazard while working from a bucket of a skid steer while conducting masonry activities.
