29 CFR 1910.22(b)(1): Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard:    On or about April 11 2014, the passageway that goes from the entrance of the carwash going to the exit of the carwash, contained trip hazards as the result of missing bricks/ cobblestones  being placed in the direct path of employees utilizing the passageway. This was located in a main passage way of the car wash facility.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  On or before April 11, 2014, the employer failed to provide hazard communication program training for employees who work with chemicals, including but not limited to: Opti-plus, Blue Power, Tri-Foam, Trim Shine, Glisten, Cherry Polyshine, Sensation Foam Polish, Signature Plus, Piranha Plus, and Bay and Wall Cleaner.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein.  On or before April 11, 2014, the employer was allowing employees to transfer chemicals to secondary containers which were not labeled, including but not limited to: Trim Shine and Piranha Plus for daily use by management and employees.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  On or before April 11, 2014, the employer failed to provide current safety data sheets for each hazardous chemical used at the car wash.  Current chemicals in use are: Opti-plus, Blue Power, Tri-Foam, Trim Shine, Glisten, Cherry Polyshine, Sensation Foam Polish, Signature Plus, Piranha Plus, and Bay and Wall Cleaner.
