29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:     On or about April 9, 2014, and at times prior thereto, at the job site located at 8604 Highway 107, in Sherwood, Arkansas, where employees were constructing masonry block walls, the employees were working from welded tubular frame scaffolding that was missing toe boards, guard rails, and cross braces. The scaffold was partially dismantled and reassembled several times during the work shift, but was not inspected after each modification. The scaffold was missing cross braces, toe boards, and fall protection. These conditions exposed the employees to struck by hazards and to the hazard of falling approximately 13 feet to the ground below.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:    On or about April 9, 2014 and at times prior thereto, at the job site located at 8604 Highway 107 in Sherwood, Arkansas where employees were constructing masonry block walls, the employees were working from a two tier welded tubular frame scaffold that did not have toe boards, safety nets, or other means to protect employees working below from falling objects. These conditions exposed the employees to the hazard of being struck by falling objects.

29 CFR 1926.452(c)(2): Tubular welded frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof, which would have secured vertical members together laterally:       On or about April 9, 2014, and at times prior thereto, at the job site located at 8604 Highway 107, in Sherwood, Arkansas, where employees were constructing masonry block walls, the employees were working from a two tier, welded tubular frame scaffold that was missing 22 cross braces on the interior side of the scaffold. These conditions exposed the employees to fall and struck by hazards in the event of a scaffold collapse.

These conditions exposed the employees to the hazard of falling approximately 13 feet to the concrete floor below.
